Protected confidential information in Algerian legislation and agreementTrips
Abstract
Confidential information is one of the most important elements of intellectual property, as it is one of the intangible elements of commercial and financial value that requires legal protection under a number of conditions. In order for the law to offer protection, it is necessary to operate on the exploitation of the means by which all the rights of the owner of the undisclosed information are included. In this regard, whether the confidential information falls within the framework of contractual or non-contractual relations, the responsibility department remains in place, and although the Algerian legislator has not established a unified regulation for confidential information and is not mentioned that in separate texts it remains of a value that requires protection for its owners. On the other hand, we find that the TRIPS convention has an effective effect on protection, even though it was the first form of its consecration, and that it was not previously dedicated to protection, it these are unfair practices that require protection.
