Abstract

Abstract: Liability insurance is an imperative necessity imposed by the tremendous technological and industrial development and the control of the machine over the production process, which has led to the growing risk potential, which has become a direct threat to consumer health and safety, especially in the field of consumer products, especially pharmaceuticals. With the development of civil liability rules, which have become based on the defect of the product and not the fault of the producer, as well as the aggravation of liability claims resulting from the damages caused by defective pharmaceutical products, it was necessary to develop a mechanism that serves as a financial solvency that provides the necessary protection for the producer and helps him to continue his activity on the one hand, and also provides a kind of protection for the consumer of these products on the other hand, and even makes them mandatory, which is what the Algerian legislator went to through both Law 95-07 on insurance. Executive Decree 96-48 of 17 January 1996 laying down the conditions and modalities of insurance in the field of civil liability for products. Therefore, this study aims to reveal the role of compulsory liability insurance in protecting consumers from the danger of pharmaceutical products
