Specialized penal poles as an approach to combating business crimes

Abstract

Most legislatures, including the Algerian legislator, have adopted the concept of Specialized Criminal Poles. This approach is based on judicial specialization to combat emerging crimes, curb their proliferation, and counter the evolving methods of their commission along with their dire consequences. These poles are characterized by their extended territorial jurisdiction and their exclusive authority to adjudicate only the specific crimes prescribed by law. The legislator did not designate a unique set of procedural rules for them; instead, they are subject to the general rules governing public prosecution, investigation, and trial. Nevertheless, they possess certain distinct characteristics that differentiate them from ordinary jurisdictions, particularly regarding their seising of crimes and the innovative, exceptional mechanisms and tools placed at their disposal for search, inquiry, and investigation.
