Protecting competition from anti-competitive practices in the banking sector

This study addresses the issue of protecting competition from anti-competitive practices in the banking sector. Within this framework, the challenge of applying competition law provisions to stakeholders in this sector—banks and financial institutions—particularly regarding anti-competitive practices, becomes apparent. This is crucial for maintaining free competition in banking markets, despite their inherently regulatory nature, stemming from their subjection to the regulations of the Monetary and Credit Council within the framework of banking activity regulation, alongside the role played by the Banking Commission. These two bodies, acting as regulatory authorities in this context, may lead to the issue of overlap between them and the Competition Council.
