Abstract

Despite the scarcity of writings, on this topic nowadays, it is considered among the
most important family issues. as Those who say that Efficiency is required in marriage
for the benefit of women; in order to preserve the stability of the family and permanence
of marriage, to achieve tranquility and affection between spouses, and to reduce divorce
cases and its negative effects on children and societies, but they differed in the
descriptions considered in competence and agreed on describing Religion, which means
besides Islam righteousness and commitment to the provisions of the Sharia.
 Through the research, it was found that the attributes of competence are not fixed,
but rather change with the change of circumstances, except for the description of religion,
which is fixed, which means the possibility of dispensing with some descriptions and
replacing others called for by reality. Efficiency in marriage into consideration.
However, the family legislations should take competency in marriage into
consideration
