Marital competence in a mixed marriage

Abstract

A mixed marriage is concluded between a national and a foreigner., it raises the question of the difference of religion : marriage between a Muslim woman and a non-Muslim man. According to the rules of conflict of laws the applicable law is the national law of the spouses, which may be the law of nationality of the husband to the effects of the marriage which seems contrary to the principle of equality between men and women. But concerning the nationality the legislator allowed the woman to keep her nationality after the marriage with a foreigner
