Tourism exploitation of the beaches within the framework of concession contracts

Abstract

Abstract: Concession is one of the legal mechanisms adopted by the state to exploit its public property, including beaches. 03-02 of Dhu al-Hijjah 16, 1423 corresponding to February 17, 2003 setting out the general rules for the tourism use and exploitation of beaches, as well as in Executive Decree No. 04-274 of 20Rajab 1425 corresponding to 05 September 2004 setting the conditions and modalities for tourist exploitation of beaches open for swimming. Through this study, we decided to stand on the legal framework regulating the privilege of tourism exploitation of the beaches, in order to determine the legal nature of this contract, and the methods of concluding it. Concession contracts for tourist exploitation of the beaches are linked to several factors that must be taken into consideration
