The legal framework for environmental protection within the context of sustainable development in Algerian legislation

Abstract

In the context of Algeria's endeavors to adopt an integrated approach combining environmental conservation and sustainable development, the state has enhanced its legislative framework. This was achieved through the enactment of Law No 03-10 concerning environmental protection within sustainable development, along with its implementing decrees, in addition to ratifying international environmental agreements as part of its commitment to the 2030 Sustainable Development Agenda. These efforts have resulted in establishing a comprehensive framework incorporating preventive mechanisms, deterrent regulations against environmental violations, and the activation of participatory mechanisms involving various environmental stakeholders. However, practical implementation faces significant challenges, primarily: limited awareness, inadequate monitoring mechanisms, and insufficient allocated resources. This necessitates reinforced efforts through: Enhancing the monitoring system's effectiveness, Strengthening economic incentives, Activating community participation mechanisms, and Fostering international cooperation in clean technology. These measures aim to ensure the crucial balance between economic development requirements and environmental preservation imperatives for current and future generations.
