Limits of the primary insurer's agency in joint insurance contracts

Abstract

 To enable insurance companies to guarantee the major industrial risks, the Algerian legislator has put in place a legal mechanism called Co-insurance, which is defined as the contribution of several insurance companies to cover the same risks, under a single insurance contract, in which the management and the execution of the contract are entrusted to one of the insurers who contribute to covering the insured risk, he is called the main insurer, who is duly assigned by the other insurance companies involved in the coverage of risks. The broadest powers that the main insurer can enjoy are: concluding a co-insurance contract whereby he negotiates with clients, and then he concludes the contract, amends and renews it as the expiry date of the contract approaches, managing these contracts by taking charge of premium payments, paying compensation, settling accidents, and initiating solutions claims in some branches of insurance.
