The scope of freedom of contract in competition law
Keywords:
Competition, contracts, the competitive economic system, economic agentsAbstract
The scope of contractual freedom for economic agents within competition law represents the relationship between the principle of contractual freedom and the principle of free competition, which underpins the market economy system adopted in Algeria. While the principle of free competition is intended to enhance contractual freedom for economic agents in the market, this freedom must not become an obstacle to free competition. In such cases, competition law intervenes to restrict economic agents in order to safeguard free competition, through the prohibition and monitoring of contractual practices that restrict competition.
