The Real Estate Promoter Activity as Regulated by the Promulgation of the Law N° 04/11

Abstract

Regulating the real estate activity has been one of the most prominent challenges faced by the Algerian legislator. Despite of the promulgation of laws related to these activities, the legislator has been unable to close the loopholes and address all aspects of this activity, until the issuance of Law 11/04, which includes the rules governing real estate activities. This law regulated the activity of the most important intervening element, which is the real estate promoter. Accordingly, this paper aims at shedding light on the promoter as the most significant actor in this field and highlighting the conditions and obligations imposed by the Algerian legislator on this latter in order to practice their profession as well as the administrative penalties applied in case of non-compliance.
