Abstract

ract: Whenever a debtor fails to fulfill his debts voluntarily when they fall due, a creditor who fears the loss of his right to fulfill them may initiate a preventive measure that enables him to isolate all or some of the debtor's movable or real estate assets and place them in the hands of the judiciary to preserve them from any smuggling or disposal that may jeopardize his rights. This procedure is known as the provisional seizure of the debtor's assets, which is of great practical importance in protecting the general security of creditors, which is the reason for researching its provisions and procedures in order to identify the new developments that have occurred and the shortcomings
