Abstract

The co-ownership system is seen as one of the essential pillars of the world's property structure, as it offers the opportunity to use housing in a participatory manner, respecting the rights of others. However, the implementation of this system in Algeria in the property development sector raises a number of legal issues, often illustrated by the ineffectiveness of the existing legislative framework, particularly in terms of striking a balance between the rights of the buyer and the responsibilities of the property developer. The reasons for the ineffectiveness of these laws and their application in a way that strengthens the legal guarantees for both parties in the relationship raise questions. It is important to take these reasons into account and find solutions that safeguard rights and deter offenders in a way that is compatible with the nature of the Algerian citizen and the political and economic circumstances of the State.
