Contractual negotiation, According to the Law 18/05 Relating to Ecommerce

Abstract

This study aims at stating the legal system which rules negotiations in the field of E- commerce contracts through the electronic negotiation and specifies the commitments and responsibilities that rise up from these negotiations. And, regarding the efficient role of such negotiation in solving the conflict which may occur in the future under the obligation and the execution of the E- commerce contracts, the comparing legislations gave an extreme importance to this stage, among which the “Algerian Legislation” which included it into the E- commerce law 18/05 after it refused to introduce it into the civil law texts, thus the Problematic is centered around the legal framework of negotiating the E-commerce contracts.
