Abstract

Abstract: The paper presents an legal remarks on the Algeria- Francc convention of 1988 that treats the phenomenon of the mixed marriage which had been coming into ‎a particular issues to restrict the child abduction from/to Algeria.‎ The study shows that the previous agreement was used for the benefit ‎‎‎of ‎one party. It explores that ‎its primary purpose was to recover the ‎‎child by his incubator, however, ‎this convention included a ‎‎procedures ultimately serve of the interest of the French mother not the best ‎‎interest of the child.‎ The research attempts to fill the gaps in the convention by proposing a substantive amendment relating to the dissolution of the marriage.
