Abstract

The Tunisian legislator approved criminal compensation as an alternative to short-term imprisonment and added it to the provisions of the Penal Code under Articles 5 and 15 IV of Law No 68 of 12 August 2009, in accordance with the recent punitive policy, which is based mainly on the protection of human rights and the imposition of sentences and the social reintegration of the convicted person. The law governing the penalty shall set the conditions for the replacement of the penalty of deprivation of liberty by the penalty of penal compensation and the manner in which it is executed to obtain the effects of the execution and the absence thereof.
