Legal restrictions on the right to dispose of subsidized housing in Algerian legislation

The Algerian constitution enshrined the principle of the protection of private property, but on the other hand it stipulated that the exploitation of the properties associated with the right of ownership must comply with the public interest approved by the law, which makes the right to private property a relative right that limits its release from legal restrictions established for the public or private interest, which It represents a legitimate justification for violating this right. Within the framework of the policy adopted in the field of housing, the state has made considerable efforts to implement housing in all its forms. In order to put an end to the potential speculative operations at the expense of the national pillar, the disposal of the beneficiaries of these housing units was restricted during a certain period in accordance with specific controls so as not to empty the right of ownership of its essence.
