Abstract

Pre-contractual negotiations have imposed themselves in working life, especially in contracts for large projects with huge financial returns, They are no longer mere discussions, consultations and exchanges of views, but have become tightly regulated by parties wishing to contract, with the participation of experts and technicians from various disciplines, reflected in the form of preliminary agreements (principle agreement and framework agreement) or interim agreements (partial agreement and provisional agreement), This has given rise to a wide question of the legal value of such agreements in the light of their multiplicity, the diversity of their functions and their different designations, which may require the future intervention of the law to outline them in order to standardize terminology and define concepts, in order to achieve the legal security sought by all civil legislation.
