Abstract

Proceeding from the Algerian legislator’s endeavor to protect financial and commercial transactions against illegal practices related to trade and economy, and to reduce business crimes in several areas, including the field of consumption by curbing and suppressing consumption crimes, and ensuring effective protection of consumer interests in the first place. , the latter, which constitutes the weakest link in the contractual relationship, in addition to regulating commercial activity, the Algerian legislator has taken the initiative to enact legal texts containing strict legal rules and procedures that ensure consumer protection from fraud and deception, among which we mention the Consumer Protection Law Cheating No. 03/09 for example, this is on the one hand. On the other hand, ensuring effective penal protection through the Algerian Penal Code and the Algerian Code of Criminal Procedure. Which is what the Algerian legislator actually embodied, by imposing controls of a deterrent penal nature by criminalizing illegal business practices that are contrary to the requirements of the law, and imposing the necessary penalties on their perpetrators, given the lack of protection enshrined in the rules of civil law, in addition to its dedication to a set of legal mechanisms Which ensures that the consumer is informed of penal protection against crimes that would afflict his material and moral interests from specialized agencies and bodies entrusted with the task of controlling goods and products and examining their compatibility with legal standards and ensuring the control and suppression of consumption crimes, and ensuring the imposition of penalties Criminal charges in the event that the economic aid fails to comply with its obligations towards the consumer. This is based on the Algerian legislator’s conviction of the extent of the importance of penal intervention in achieving the necessary and effective protection for dealers in the field of business, not to mention addressing all relevant problems that arise on a practical level, all with the aim of ensuring compliance with the ethics of economic dealing and avoiding the occurrence of the so-called economic deviation .
