Conflicting Issues in the Enforcement of Penal Judgments and Related Lawsuits

Conflicting issues in penal enforcement or disputes are of a judicial nature, as considered by Algerian legislation, which deems them procedures under the jurisdiction of the judiciary alone. This was affirmed by Article 14, paragraph 1, of the Law on the Organization of Prisons and the Social Reintegration of Detainees, which stipulates that conflicting disputes related to the enforcement of penal judgments can be raised by a request before the judicial authority that issued the judgment or decision. Through the text of the article, it becomes evident that it is a penal lawsuit within the jurisdiction of the judiciary, ensuring the rights of the convicted who resort to the judiciary for resolution, where its procedures are initiated, and a judicial ruling is issued regarding it. The condition of standing and interest must be met by the plaintiff in raising the conflicting dispute, and through this topic, we attempted to shed light on the concept of conflicting issues in the enforcement of penal judgments and related lawsuits and the conditions for raising them before the competent authorities.
